Terms of Service

1. Account Registration

To access our API, you must create an account and maintain accurate billing information.

Security: You are responsible for maintaining the confidentiality of your API keys and account credentials.

Eligibility: You must be at least 18 years old and capable of entering into a legally binding agreement to use this service.

2. License and Usage

We grant you a limited, non-exclusive, non-transferable license to use the AddressBox API to provide address autocomplete functionality within your applications.

No Scraping: You may not use the API to bulk-harvest address data or create a standalone database of New Zealand addresses.

Caching Policy: Temporary caching of results is permitted to improve performance, but permanent storage of our data is prohibited without written consent.

3. Fees and Payment

Billing Cycle: Subscription fees are billed in advance on a monthly or annual basis via Stripe.

Taxes: All stated fees exclude Goods and Services Tax (GST) and any other applicable taxes, which will be added to your invoice if we are required by law to collect them.

Usage Limits: If your usage exceeds the limits of your selected plan, we reserve the right to charge overages or suspend the API key until the next cycle.

Refunds: Payments are non-refundable. You agree that you are acquiring our API services for the purposes of a business in trade, and therefore the provisions of the New Zealand Consumer Guarantees Act 1993 do not apply.

4. Service Availability & Support

While we strive for 99.9% uptime, the service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We reserve the right to modify or discontinue features of the API with reasonable notice to active subscribers.

Technical support is provided via email and is prioritized based on your subscription tier.

5. Limitation of Liability & Data Attribution

To the maximum extent permitted by New Zealand law, Opticras Digital Limited (trading as AddressBox) and its suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

Data Source: AddressBox uses address data sourced from Land Information New Zealand (LINZ). This data is licensed under the Creative Commons Attribution 4.0 International license.

Accuracy: While we source data from reliable New Zealand authorities, we provide the service on an "AS IS" basis and do not guarantee that every address returned is 100% accurate, complete, or up-to-date.

Usage Risk: You assume all responsibility for the use of address data within your application, including the validation of physical deliveries or emergency service routing.

Our total liability for any claim arising under these terms shall not exceed the amount paid by you to us in the 12 months preceding the claim, or $100 NZD, whichever is greater.

6. Governing Law

These terms are governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law principles.

Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the New Zealand courts.
